Probate is the legal process used to administer a person's estate after death. Depending on how the property was owned and the circumstances of the estate, real estate may or may not need to go through formal probate.
For example, California Courts explains that property held in a living trust can generally transfer to the named beneficiary without going through probate. Property held in joint tenancy or with certain survivorship provisions may also transfer differently.
That means one of the first questions to answer is:
How was the property owned?
Was it:
Owned by a living trust?
Owned individually by the person who died?
Owned jointly with a spouse?
Held in joint tenancy?
Subject to another form of ownership or beneficiary designation?
The answer can significantly affect what happens next.
What Is a Trust Sale?
A trust sale generally involves real property owned by a trust and administered by a trustee.
The trustee is responsible for managing the trust property according to the trust documents and applicable law. California courts explain that trustees may ordinarily have authority to make reasonable repairs, insure property, sell assets, pay certain expenses, and distribute assets according to the trust—subject to the trust document and California law.
Selling a trust-owned home can therefore involve more than simply putting a property on the MLS.

Do I Need a Probate Realtor in San Pedro or Rancho Palos Verdes?

The question should be:
“Will this improvement likely create enough additional value to justify the cost, time, and hassle?”

The tax basis of inherited property can be affected by the date of death and other circumstances. Trust and estate situations can also involve complicated tax considerations.
There can also be a major distinction between income-tax basis and California Proposition 13 property-tax basis.
These are not the same thing.
That's why I don't try to give clients tax advice. Instead, I encourage trustees and beneficiaries to ask their CPA, enrolled agent, or tax attorney specifically about the property's basis and potential tax consequences.

Does Probate Always Mean the Court Has to Approve the Sale?
Not necessarily.
The procedure depends on the type of estate, the authority involved, the property ownership, the governing documents, and the circumstances of the sale.
California probate sales can involve specific court procedures. For example, California courts provide forms and procedures for certain sales of real property in probate, and Los Angeles County has specific rules addressing petitions to confirm sales of trust real property in circumstances where court approval is required.
This is another reason I recommend that trustees and executors work closely with their probate or trust attorney.
Don't assume every inherited property follows the same process.

What happens if the property needs to be sold quickly?
How will you help me from the initial property evaluation through closing?
The right Realtor should be more than someone who puts a sign in the yard.
For an estate property, you may need a project manager, communicator, negotiator, and local resource who understands that you're dealing with much more than a house.
